Thought Crime Bills Threaten Talk Radio

     HR 1966 has cleared the House and now faces the Senate as S.909, the Matthew Shepard Hate Crimes Prevention Act (officially, the Local Law Enforcement Hate Crimes Prevention Act). The bill is expected to sail through the Senate as it did in the House. It will provide federal assistance to the states, local jurisdictions, and Indian tribes to prosecute hate crimes, and for “other purposes.” It creates special protective status based on race, color, religion, national origin, gender, sexual orientation, gender identity, and disability.

 

     S.909 is a direct violation of the First Amendment. It allows the federal government to prosecute people involved in “hate speech” transmitted over television, radio, and the Internet. The House version of the bill states:

Whoever transmits in interstate or foreign commerce [radio, TV, Internet] any communication, with the intent to coerce, intimidate, harass, or cause substantial emotional distress to a person, using electronic means to support severe, repeated, and hostile behavior, shall be fined under this title or imprisoned not more than two years, or both (HR 1966, SEC 3, Sec. 881a).

 

     In other words, if a talk show host engages in “hostile” speech against a person or persons of the above mentioned federally protected group that talk show host will face federal prosecution and the prospect of a two year prison term (this will also affect true Christians who reveal the truth to a lost world that God so loved the lost sinner, including sodomites, that He died for their rotten sins, including sodomy [the Bible will be considered "hate literature"]).

 

     According to Alan Potash, director of the Anti-Defamation League for the Plains States, “freedom of speech does not extend to racist groups.” The ADL played an instrumental role in passing the Hate Crimes Prevention Act. “ADL has long been in the forefront of national and state efforts to deter and counteract hate-motivated criminal activity. Hate crime statutes are necessary because the failure to recognize and effectively address this unique type of crime could cause an isolated incident to explode into widespread community tension,” the ADL website states.

 

     In the wake of a series of crimes the corporate media and the ADL have linked to “white supremacists” (the killing of police officers in Pittsburgh and the attack by James von Brunn on the Holocaust museum in Washington), the ADL and its partners on the so-called left have engaged in an orchestrated campaign to demonize groups and individuals that are not racist or separatist. The Department of Homeland Security drafted a template for this persecution with its report on “rightwing extremism.” The DHS and police agencies around the country have linked pro-life, states’ rights and anti-illegal immigration activism and support for the Second Amendment to racist thought crime as defined by the ADL and the Southern Poverty Law Center.

 

     During a speech delivered at the Anti-Defamation League National Leadership Conference in Washington, DHS secretary Janet Napolitano admitted the agency enjoys a special relationship with the ADL. Napolitano said the ADL and DHS “have had some good partnerships” and said the agency has placed its employees in the ADL’s “advanced training school to educate us on the tactics used by extremists and terrorists. After the white supremacist Richard Poplawski allegedly killed three police officers in Pittsburgh, the ADL attempted to link radio talk show host Alex Jones to the crime. “One of Poplawski’s favorite places for such conspiracy theories was the Web site of the right-wing conspiracy radio talk show host Alex Jones. Poplawski visited the site, Infowars, frequently, shared links to it with others, and sometimes even posted to it,” the ADL wrote in an article on Poplawski.

 

     California Democrat Rep. Linda Sánchez introduced the Megan Meier Cyber-bullying Prevention Act in April, a bill so egregious it earned the title the “Censorship Act of 2009.” On May 6, Sánchez wrote for the Huffington Post: “The Supreme Court recognizes that in some instances words can be harmful. For example, you cannot falsely yell ‘FIRE’ in a crowded theater. If you say it even once you can be held liable. Yet, you can repeatedly emotionally abuse someone with words, pictures, and false impressions online and get away scot-free.” Sánchez’s bill contains the following language:

     As law professor and blogger Eugene Volokh noted on April 30, the bill will allow the government to go after bloggers and Internet journalists engaged in speech that may result in “emotional distress.”

The ADL is also involved in making sure the Megan Meier Cyber-bullying Prevention Act is passed and used against its enemies. “Whether cyber-bullying is related to identity-based group membership, however, or more universal characteristics such as appearance or social status, online social cruelty can produce devastating consequences for the targets and may be a precursor to more destructive behavior, including involvement in hate groups and bias-related violence,” the ADL writes on its website.

 

     HR 1966, S.909, the Megan Meier Cyber-bullying Prevention Act and other such legislation will be used to shut down, prosecute, imprison, and thus silence the opposition. HR 1966 covers television and radio, while the Megan Meier Cyberbullying Prevention Act addresses the Internet. The DHS — at the behest of the ADL — has accomplished its essential work of demonizing constitutionalists and patriot groups and individuals as domestic terrorists. Corporate media propaganda continues to deliver the message that opposition to illegal immigration, abortion, and support for the Constitution and the Bill of Rights is “extremism” that will result in the murder of late term abortion doctors, police officers, and security guards.

     Homosexual activists at the University of Colorado in Colorado Springs are demanding removal of the student body president after he cited his personal beliefs and values in allowing a $2,100 funding request from school money for a "Coming Out Day" to be approved without his signature. David Williams' decision to allow the funding without his signature "caused students to feel unsupported and unrepresented by their student government," said Crystal Duckhorn, a spokeswoman for the campus organization Spectrum, which eventually used the money for its celebration of homosexuality. The situation was reported by The Colorado Springs Gazette reported members have argued that Williams was not objective, because he signed off on funding requests for other clubs. Students say they now are gathering signatures for his recall.)

 

     "Funding an organization should not be dependent on viewpoint," Duckhorn told the newspaper. Williams said when the funding request came through, he did not veto it, because he believes Spectrum is entitled to funding through the student government. Without his veto or signature, the student government procedures automatically approve the request after five days. But Williams said he couldn't sign it, because it conflicted with his personal beliefs, the newspaper said. "My job is to represent the entire student body, which includes Spectrum and people who think the way I do," he told the newspaper. "I believe what I did was right and fair." The school's student judicial board now has ruled that Williams "discriminated" against Spectrum in his actions, and he could face a recall or impeachment, the newspaper said. The 'discrimination" ruling "chips away at an individual's right to free speech and free thought," Williams told the judicial board made up of nine students, according to the Gazette.

 

     "It also demonstrates that a particular group, when offended, can complain and wrongfully get their way," he said. Williams told the newspaper he now doesn't feel safe utilizing his First Amendment rights and is hiring a lawyer to protect himself from Spectrum, the student government and others. The judicial board ruling also included a determination that Williams was not in violation of a requirement that leaders be objective in making student funding decisions. The controversy has prompted Chancellor Pam Shockley-Zalabak to become involved. She is calling for an audit of three years of student activity fee uses. She also wants a review of the student constitution to hunt for violations of U.S. Supreme Court precedents on the use of student fees.

 

     On the Gazette's forum page, the comments varied: "He absolutely has the right to freedom of speech, and he took it. That right goes both ways! He is a politician at his college, and the students have EVERY right to attempt to remove him if they don't feel that he represents them." "The guy is given the power to say "yea" or "nay." He chose "nay." That is not abuse of power. It is use of power. Hey - that sounds just like the government of the United States of America." "How desperate does the gay community AND spectrum have to get? They were denied NOTHING, yet instead wanted to FORCE acceptance on a moral basis. How sickening is that?"

     The Thought Police (thinkpol in Newspeak) are the secret police of Oceania in George Orwell's dystopian novel Nineteen Eighty-Four. It is the job of the Thought Police to uncover and punish thoughtcrime and thought-criminals, using psychology and omnipresent surveillance from telescreens to find and eliminate members of society who were capable of the mere thought of challenging ruling authority. The government attempts to control not only the speech and actions, but also the thoughts of its subjects, labeling unapproved thoughts with the term thoughtcrime, or, in Newspeak, crimethink. It was the Thought Police that had arrested Winston and Julia. The Thought Police operate a false resistance movement in order to lure in disloyal Party members, before arresting them. It is unknown, however, if a genuine resistance movement exists.

 

      The Thought Police also move among the Proles, spreading false rumors and marking down and eliminating any individual deemed capable of rebellion against the Party or Independent thought. All Party members live their lives under constant supervision of the Thought Police. Every Party member has a Telescreen in his or her home, which the Thought Police uses to observe every single action, and takes note of anything that hints of unorthodox opinions or an Inner Struggle. When a Party member talks in their sleep, the words are carefully analyzed. The Thought Police also target and eliminate highly Intelligent people, since they may come to realize how the Party is exploiting them. The only case of this mentioned in the book was of Syme, the developer of Newspeak, who, despite his fierce devotion to the Party, simply disappeared one day.

 

     It also had much to do with Orwell's own "power of facing unpleasant facts," as he called it, and his willingness to criticize prevailing ideas which brought him into conflict with others and their "smelly little orthodoxies."
